$1.7 MILLION AWARDED TO PARAPLEGIC IN ACCIDENT CASE

A Cattaraugus County jury in Olean issued a record $1.7 million dollar verdict in an automobile accident case.  Following a six-week trial, the decision was returned, in favor of the 23-year old plaintiff of Portville.  Now a paraplegic, the plaintiff’s back was crushed, when the pick-up truck he was riding in skidded on a water-covered road near the Portville Sand and Gravel pit and overturned.  Mr. Letro proved that Portville Sand and Gravel, a division of I.A.Construction Co., in Concordville, PA discharged about 2,500 gallons of water a minute onto public roadways from its gravel-making operations and the township knew of the water discharge. The jury verdict found the town and gravel firm shared 35 percent liability for the accident, but found the driver of the pick-up truck 65 percent liable.
