$2.5 MILLION FOR FAMILY OF HAMBURG WOMAN KILLED IN HIGHWAY ACCIDENT

WRONGFUL DEATH

Following a jury trial, the family of a woman killed when a paving roller fell from a Town Highway Department truck on to her car, was awarded a $2.5 million settlement from the town.  The 39-year old mother of two was crushed to death when a roller fell off an un-inspected town highway truck after the truck hit the bottom of a railroad overpass, shearing off the chain holding the roller which then flipped on top of the driver’s side of the victim’s car.  During the trial, the jury learned that the underpass had been the scene of a number of accidents for years prior to the fatal incident and that the roadway had been repaved some four months before the incident.
