STATE PAYS $850,000 TO COUPLE INJURED IN MOTORCYCLE ACCIDENT

A NYS Court of Claims Judge found New York State responsible for a motorcycle accident in which a Western New York couple, riding a motorcycle on a State road in Caledonia, N.Y., lost control of the cycle and crashed.  The driver sustained a broken wrist, while his wife, a passenger on the motorcycle, suffered a head injury, broken ribs and other injuries.  The road on which the couple was traveling had recently been painted by the NYS Department of Transportation.  A thorough analysis of the paint revealed that it did not meet the specifications necessary for it to dry quickly and fully.  The Court concluded that the State’s use of inferior paint led to the accident-causing the driver of the motorcycle to lose control when riding over the paint.  The court found the State to be 100% negligent.
